Frequently Asked Questions

Explore answers to common questions about entering the Indian market and setting up your business operations with 3S Business Advisors.

Transfer Pricing refers to the pricing of goods, services, loans, or intellectual property exchanged between related entities within a multinational group commonly referred as Associated Enterprises. It ensures that intercompany transactions are conducted at arm's length, helping businesses comply with tax regulations and minimize the risk of disputes with tax authorities.

Any Indian enterprise or foreign entity operating in India that has entered into international transactions with Associated Enterprises (AEs) or specified domestic transactions exceeding threshold limits during the financial year must obtain and file Form 3CEB certified by a chartered accountant.

Failing to maintain proper Transfer Pricing documentation or making inaccurate filings can lead to:
• Tax Adjustments: Tax authorities adjusting the transaction values, resulting in higher taxable income.
• Heavy Penalties: Penalties up to 200% of the additional tax levied in cases of under-reported income, alongside separate penalties for failure to maintain TP documentation or non-submission of reports.
• Double Taxation: Adjustments made in India without corresponding relief in the home country can lead to double taxation on the same income pool.

Businesses can strengthen compliance by establishing clear Transfer Pricing policies, maintaining accurate documentation, conducting regular benchmarking studies, reviewing intercompany transactions periodically, and ensuring alignment with applicable regulations in each jurisdiction.
